A Berkeley County Grand Jury has indicted a former Summerville Police officer on two charges related to a fatal shooting outside a Summerville restaurant.

Anthony DeLustro, 64, faces charges of attempted kidnapping and murder, according to Ashley Kay, spokesperson for the Ninth Circuit Solicitor’s Office.

Summerville Police Chief enlisted the South Carolina Law Enforcement Division (SLED) to investigate the incident.

SLED had previously charged DeLustro with murder following the shooting. Court documents released by SLED reveal that DeLustro, who was off-duty at the time, engaged in an altercation with O’Neal at the Chick-fil-A on North Main Street. During the altercation, DeLustro shot O’Neal, who died at the scene.

The Berkeley County Coroner’s Office reported that O’Neal died from a gunshot wound to the right arm, which traveled to his chest.
